Provider and scope
These terms govern business use of Sound of Service, a SaaS service provided by 10TO10, Dutch Chamber of Commerce number 85073989. Contact hello@soundofservice.eu. The service is intended for professional audio businesses. These are original terms addressing common ICT and SaaS topics; they do not automatically incorporate the Nederland ICT or NLdigital terms.
Formation and precedence
A contract arises through acceptance of an offer or subscription confirmation in the agreed manner. Visiting this website does not itself accept a subscription. Specific written terms prevail over these general terms; the separate data processing agreement prevails in case of conflict about personal data. Customer purchasing terms apply only if expressly accepted in writing. These terms must be made available before or when the contract is concluded.
Service, licence and data
We provide the agreed functionality remotely for the customer’s own business during the contract. The customer receives a non-exclusive licence within its subscription. Software, design and documentation remain protected by 10TO10’s or its licensors’ intellectual property rights. Customers retain their rights in supplied data. We use that data to provide the service and for other expressly agreed or legally permitted purposes.
Accounts and tenant isolation
The customer appoints authorised administrators, manages users and roles and promptly removes obsolete access. Credentials and access keys must not be shared without authorisation. Access depends on tenant membership and permissions. Isolation is logical, not a default commitment to dedicated physical infrastructure. Customers must not bypass isolation, misuse the service or process unlawful content.
Sharing, passports and listings
Supported collaboration, transfers, integrations and publication may disclose information outside a tenant. Customers are responsible for their instructions, recipients, publications and lawful content. Device history reflects known and recorded information and does not guarantee completeness, ownership, technical condition or authenticity. It does not replace inspection or checking rights to sell. Occasion Square facilitates listings where available; buyers and sellers remain responsible for their transaction, information, payment, delivery, warranties and applicable consumer rules. 10TO10 is not a seller or transaction party unless expressly agreed separately. Dealer involvement or recorded history is not an unlimited guarantee.
Availability and development
We exercise reasonable care in providing a usable service. Uninterrupted access, error-free operation and fixed recovery times are guaranteed only where expressly agreed in a written SLA. Maintenance or security work may interrupt access; significant planned maintenance is announced where reasonably possible. Features may change for maintenance, security or development. Future modules are included only when agreed. Support and additional work follow the contract.
Third-party integrations
Integrations may depend on external access, APIs, licences and provider changes. Customers must hold the necessary rights and share only necessary data. We are not responsible for independent third parties’ services but remain responsible for our own agreed work. Capabilities differ by integration. Enabling an integration does not authorise unrestricted disclosure of tenant data.
Privacy and confidentiality
Both parties protect confidential information and disclose it only as necessary for performance or as legally required. A separate data processing agreement covers customer personal data, instructions, safeguards, subprocessors, incidents, assistance with rights, and return or deletion. Customers are responsible for lawful processing and instructions; 10TO10 for its own controller and processor duties. Relevant breaches or misuse are reported to the affected party without undue delay.
Fees and payment
The accepted contract or subscription confirmation specifies price, included functionality, billing, duration and notice period. Prices exclude VAT unless stated otherwise. Agreed payment terms apply. Before proportionate suspension for non-payment we allow a reasonable opportunity to remedy. Immediate measures may be necessary for serious security threats or unlawful use. Price changes need an agreed basis and advance notice; mandatory rights remain unaffected.
Duration, termination and exit
Subscriptions run for one year and renew for successive one-year periods unless notice is received at least one month before the end of the current term.
Billing is monthly or annually as agreed; monthly invoicing does not create a monthly cancellation right. Cancellation can be sent to hello@soundofservice.eu.
Export remains available throughout the remaining subscription and for one month after its effective end date, with a minimum of thirty calendar days. Where a statutory switching procedure applies, any longer mandatory retrieval period following the transition also applies.
During that extra month, access is limited to arranging return/export rather than continued operational use. We cooperate with data return and applicable mandatory rights when switching services. Afterwards, personal data is returned or deleted under the processing agreement unless lawful retention applies; backups expire under the documented retention lifecycle.
A material breach may justify termination after written notice and a reasonable remedy period where remedy is possible.
Liability and force majeure
To the extent permitted by law, liability for an attributable breach is limited to direct loss and the fees paid for the affected service in the preceding twelve months. Lost profit, missed savings and other indirect loss are excluded where lawful.
These restrictions do not apply to intentional misconduct or deliberate recklessness by management, liability that cannot legally be limited, or more favourable written customer terms. They do not restrict data subjects’ GDPR rights. The parties mitigate force majeure effects; delivered performance remains payable. A third-party outage is not automatically force majeure.
Device history after termination
Technical information and service/repair history associated with devices are retained when a subscription ends or a device is transferred, so that the history can remain with the device. Ending a subscription does not itself delete that device history. This is not a basis to retain personal data indefinitely or to publish all history. Personal details, contact information and other identifying information are deleted, anonymised or restricted as required by purpose, legal basis, statutory duties and data subjects’ rights. Private tenant administration does not automatically become public or accessible to another organisation.
Changes and disputes
Posting new terms alone does not amend an existing contract. Material changes are communicated in advance and take effect only under the agreed variation procedure and applicable law. Dutch law applies. The parties first seek an agreed solution; otherwise the Dutch court competent under law has jurisdiction. Version 14 October 2026. The Dutch version prevails in case of translation differences to the extent legally permitted.
